Notable & Larcenous: Fidelismo Sin Fidel

"One of the more stinging critiques Cuban exiles get is that we are all here waiting for the castro regime to topple to regain all of our properties and homes. I've always taken issue with that because not all of us were rich landowners and not all of us, rich landowner or not, would go back to Cuba to try to regain what was usurped. It's obviously not his home or his business. What Val is saying is that the Communist piñata should be validated in a post-Castro Cuba as it was in a post-Sandinista Nicaragua. He is apparently unaware of the fact that in the former Eastern bloc countries all properties confiscated by the Nazis and Communists have been returned to their legitimate owners or their heirs, including pre-revolutionary palaces and family estates.

Because Communist society is built on a foundation of theft does not mean that the same foundation should be used in reconstructing a democratic society under the Rule of Law. In fact, it would undermine civil society and make reconstruction itself impossible.

Since Val has always supported the return of confiscated properties to their American owners before lifting the U.S. trade embargo on Communist Cuba, it is only Cubans, both here and on the island, not his fellow Americans, who must consent to bear the burden of the Revolution's redistribution of the nation's patrimony to its henchmen. Because there was no "Agrarian Reform" under Castro: the fallow lands which the regime now proposes to lease to sharecroppers is proof of it. Nor was there any "Urban Reform," either, since the State maintained sole control of all confiscated real estate, collecting rents on it for nearly 50 years before deciding to let the occupants "buy" the ruins that they inhabit.

No one will ever maintain in good repair something which is not his and which he knows is not his. The upkeep of property is yet another benefit which a society derives that recognizes property rights. This holds true also for the sugar mills and other industries confiscated and run to the ground by Castro. The land on which they were built, more than the ruins on it, are still a valuable asset and should be returned to their legimitate owners rather than monopolized by the State or auctioned off to foreign corporations, as will be the case in a post-Castro Cuba unless the Rule of Law is upheld as pertains to private property.

I have had this debate before with someone who should be smarter than Val Prieto but isn't. Like Babalú's "Founding Editor," Professor Eduardo Peñalver, of Cornell University Law School, is willing to throw the Rule of Law "under the proverbial bridge," but unlike Val, who recognizes the ultimate injustice of doing so, the professor actually maintains that pre-revolutionary Cubans do not "deserve" to have their properties returned to them while maintaining at the same time that American Indians should have their tribal lands returned to them and African-Americans should receive reparations for the wrongs done to their ancestors.

The guy is Cuban-American, of course.

Professor Peñalver is a fine example of what takes place when educated people do not employ wisdom, I've said this before and I reiterate it again, intelligence and education are not sufficient for sound judgment, wisdom is developed and continues to be nurtured as long as people are willing to be open minded and sometimes impartial about the issues that require analysis, otherwise we wind up with the likes of the professor, who clearly is a fine example of a Kool Aid drinker. Tenure should be completely eliminated, like Socialism and all its cousins, tenure imbues its holders with untouchability, no matter how idiotic and ineffective their ideas and job performance is matters not, tenure is a Socialistic idea in principle and in practice, we are all very well aware of the consequences of Socialistic ideology and its practices.

Concerning property rights, I am not interested in reclaiming any of the houses that my family owned, if however compensation for having had them stolen from us is considered, I certainly would be willing to receive my fair share of it. The business and land that we owned on the other hand, I expect to have them returned to us, one of them still houses a primary and a secondary school, my grandfather used to charge the school district one peso per year because he was not allowed by law to have it occupied rent free. The other business properties included the main family owned company that my grandfather and his brother had originally acquired and expanded in the early 1930s during the depression, they had their money at home and did not lose a penny when the collapse came, my grandfather's brother sold his interests to my grandfather in the late 1930s and moved to Havana, further expansions of the biz were performed through the 1940s and 1950s, the biz employed dozens of people, all of whom were so well remunerated that the negotiations with the labor unions used to take less than half an hour, for their members received better pay and benefits than was customary for their field of endeavor. The value of these properties is not chicken feed, they were stolen from us and in a future tyranny free Cuba where the rule of law must prevail, we have a right to expect their return to us and not to any usurpers whose intentions will be to profit from what is not rightfully theirs.

This is a piece of worrisome news:

SAN JUAN, Puerto Rico—"Authorities say a former official with a Cuban-American group that was once the foremost voice representing the exile cause in Washington was shot dead in a Puerto Rican suburb.
Police say 64-year-old Emiliano Infante Segrera was killed Monday afternoon outside a suburban San Juan hardware store by a gunman inside a car. He was a longtime trustee of the Miami-based Cuban American National Foundation.

Police Lt. Luis Diaz told the newspaper El Nuevo Dia that Infante appeared to be shot by an expert marksman.

The killing is under investigation and no arrests have been made.

Francisco Hernandez, the foundation's president and co-founder, said Tuesday that Infante devoted his life to promote democracy on the communist nation."

I do not like to pre-judge a person's character without having sufficient knowledge about that person's words, works and most importantly his/her actions, having said that, I find it awfully convenient that all of a sudden and apparently out of the dark corners of the US intelligence community, specifically the U.S. Army Counterintelligence, we Cuban-Americans are being paid attention to by a Lt. Col. Chris Simmons whom supposedly is an expert on communist Cuba's intelligence works in the USA, not coincidentally agent Simmons has a book in the works and recently completed a draft of it which will be titled "Shadowplay: Cuban Intelligence Operations in Latin America & the Caribbean."

While I am certainly grateful to the Lt. Colonel and the work of the US Intelligence Community as a whole, especially anything and everything they have done and are doing against castro's spies, I just find it way too convenient to be paid attention to all of a sudden, after so many decades of our community having repeatedly warned anyone and everyone we could about the evil plans of the Cuban people's oppressors and having been ignored and accused of being crazy and over the top, call me a cynic and you would be correct to label me as such, at least as far as it pertains to the subject matter.

Most of the average John Q Publics will not buy the book, which is probably one of the main reasons why the Lt. Colonel is making the circuit of the usual Miami Cuban-centric media outlets, he will even appear on the Babalu Radio Hour on August 6th, I wish him well on his endeavor for I am a staunch supporter of the free enterprise system, but I'll probably wait for the movie to come on any of the premium channels that I get from DirecTV, if I am in a hurry to watch it, I might consider buying a copy on DVD from one of the Oriental ladies that traverse my neighborhood's main thoroughfare on Saturdays, usually they sell for $5.00 a piece, not a bad deal.

I get the sense that some exiles are worried that this issue will be a huge impediment to reconciliation between Cubans on the island and those returning from exile. Will this issue sour the acceptance of exiles? I am not sure. The communists like to "remind" the populace that the exiles are salivating to come back and take their homes.

Recently, a friend took a photo of our house in Camaguey, and I must say it did not look too bad. We don't know who lives there now. However, the city, from what I saw on Maria Elvira, looks destroyed.

MAT, what assurances are there that the rightful owners will make the necessary investment in the returned property to make it a viable part of the economy? For example if a factory is returned to the rightful owner and that owner does nothing to rehabilitate the factory to a productive state, how does that help the country's economy? And let's say for example a majority of restored owners decide simply to cash out and sell to foreign interests, aren't we recreating some of the same conditions that got Cuba into trouble in the first place?

It is just as tyrannical for the state to steal your property as it is for it to mandate that you can never dispose of your property.

What you, in effect, are suggesting is that only the property of the (still) rich be returned to them, but not the property of those who were impoverished by the Revolution.

85% of housing stock in Cuba is uninhabitable though inhabited nonetheless. Eventually almost everything will have to be demolished and rebuilt. Restoration is not even an option any more. So, in effect, we are talking about the land on which these crumbling structures now stand, not the structures themselves which are beyond reclamation.

No Cuban would want to live in a tent in an open field, nor should he. Castro's bogus welfare state will be succeeded by a real one, whose first concern will be to shelter the millions of Cubans who were disposessed by the Revolution's destruction of the housing stock and failure to replenish it.

I don't disagree that property rights need to be respected and restored wherever they are verifiable according to to a legal framework that is established, keeping the interest of property owners paramount.

However, I was asking a question concerning the "day after." Because the restoration, in spirit, should stand for more than a simple return of property. It also has to stand for the return of a brighter future for Cuba as well, no? Other wise all this chest-beating for so many years will seem a little less principled. Or should I just assume the old adage is true even in this tragic case?

I think everyone, rich and poor alike, were impoverished by the revolution. Do I detect a bit of class struggle in your tone?

If you want to have a discussion on this, I would be fascinated by your thoughts. How do you carry out the restoration of property in a manner that not only salves the longings of the victims, and at the same time serves the interests of an economy that needs rebuilding?

I do not know the answer. I'm not sure it is even possible to reduce to a formulaic solution. But a grand opportunity is coming soon. And in my mind, even a leap of faith has to be helped along.

Before 1959, it was virtually impossible for a landlord to evict a tenant in Cuba. Not only were the courts and the police of no help, but the neighbors would prevent such evictions from talking place through violent means if necessary. In the end, if a landlord wanted to get you out, he would have to pay you to move even if you were months or years in arrears to him.

Take that as a point of reference.

Evictions only became commonplace in Cuba after Fidel Castro became the country's only landlord.

No one is going to be evicted from their homes in a future democratic Cuba. But neither will it be acceptable for the people to continue living as squatters in crumbling buildings.

The state will have to replenish the housing stock in Cuba or else the point will come (in fact, it has come already) when a majority of Cuba's population will be homeless.

I believe there is a way to compensate the legal owners while at the same providing adequate housing for all Cubans.

Since the original structures in most cases no longer exist or are beyond repair, it is the land on which they once stood which is in contention.

The state can purchase this land from the legal owners with interest-bearing bonds and build there, not projects, but propiedades horizontales (which, incidentally, Cubans invented in the pre-Castro era) and help finance these condominiums for the Revolution's homeless. The mortgage payments, calibrated to their incomes, could, in turn, be used to pay the original owners when the bonds come due.

Of course, if an original owner or his heirs refuses to sell his property, he will not be compelled to do so. I believe, however, that most will sell unless they intend to rebuild on that land, which is their right.

I am glad to hear that you and your family are ok after the earthquake.
In reference to Centurion the new alter ego replacement for Fantomas in the RCAB, what can I say ? Is a case of esquizofrenia to the nth degree. One rectal orifice disappears for a while and the another one like Centurion pops up out of the woodwork. Who knows under what rocks these horrible creatures live. But every once in a while they journey into the light and we have to suffer them.
Centurion caanot be any other than Riubber Head since his wishes for you and your family to perish in the earthquake reveal the depths of his evil soul.

This weekend we shall mount a major expedition to return fantomas to The Madhouse. We need long stretches of time and a concerted effort to accomplish this. He has dug beaver-like tunnels all over The Madhouse and the place is still being decontaminated from his last visit. But fear not: by Sunday fantomas will be in a steel cage and his beaver teeth will be useless to him. I'm considering hooking up the cage to the electro-convulsive machine and applying the electric shocks that way.

nonee moose, as far as I am concerned, I plan to return the business properties to their full potential, they used to employ quite a number of people and that is my goal, one of the properties is currently being used for storage, the other one is being used as a gathering hall for the CTC and the FMC, as well as, for intramural scholastic competitions, we of course would have a right to do as we please with what was and would again be ours, but benefiting the people, the city of Santiago, the Province of Oriente and the national economy is my primary goal.

If only I had vanished into thin air, Vana. That has been in Manuel's every prayer these past few days. But the demons he unknowingly prays to are not interested in helping him.

As you can see, and for Manuel's own good, I am here. And as Manuel can attest, thanks to his dutiful monitoring of his Site Meter, I never left. But since Manuel has been more or less behaving himself, I have decided to give him a little break to catch his breath and to devise a more effective strategy to address the chaos he has himself inflicted on this blog. Maybe, with a little time for reflection, he will recognize that his worst enemy is himself.

With that said, I will now allow you all to return to your usual musings about Fantomas and his various alter egos, which oddly enough, seems to be the favorite topic among all of you, including Manuel. Perhaps this blog should change its name to RFAE, Review of Fantomas Alter Egos.

Yo no tengo nada contra Manolo ni RCAB, Merengue. Al contrario, estoy aquí para ayudar a Manuel. Es cierto, la mayoría de las cosas que Manuel ha escrito estoy de acuerdo con ellas, pero no estoy de acuerdo de la manera en cual Manuel las expresa.

La arrogancia de Manuel diluye el mensaje y termina haciendo mas daño. Manuel necesita liberarse de los demonios que lo dominan para que pueda usar el talento tan enorme que Dios le ha dado para el bueno de Cuba y los cubanos. Por eso estoy yo aquí, Merengue. Vine de casualidad y vi que como cubano, es mi deber ayudar a otro hermano cubano romper las cadenas de arrogancia y envidia que atan al pobre Manolo.

Mis intenciones son nobles, y pronto Manolo se dará cuenta de eso y terminaremos mejores amigos.
